Rental Agreement
This rental
agreement is entered into on , 2011 by and between
Brent Armitage, hereinafter Lessor, and ,
hereinafter Lessee. All Lessees (hereinafter referred to
collectively as “Tenant”) are jointly, severally and individually
bound by, and liable under, the terms and conditions of this
Agreement.
TERMS AND
CONDITIONS:
Tenants: The
following persons will be occupying the house. If under 25 please

Maximum 6
occupants. Any additional occupants must be cleared in writing prior
to stay.

Rental Rate:
$2,000 + $500 refundable security deposit
Check in:
3:00pm on day of arrival
Checkout:
10:00am on day of departure
Early check in
or late check out may be requested.
Payment:
All payments
shall be in the form of personal check, or cashier’s check, made out
to Brent Armitage. Credit cards may also be
accepted but will be subject to an additional bank processing fee.
Reservation
Deposit: A 50% reservation deposit is due upon the making of the
reservation and is required to hold the reservation.
Balance of
Payment: Full payment, including security deposit, is due 60 days
prior to arrival date. Late payment may result in a reservation
cancellation. Final confirmation will be sent upon receipt of full
payment.
Security
Deposit: A security deposit of $500 is due at time of final payment.
After checkout the property will be inspected for damage. Any
damages will be deducted from the security deposit. Any damages in
excess of the security deposit continue to be the Tenant’s
responsibility and must be paid within 14 days of checkout. The
security deposit, minus any damage fees, shall be refunded to Tenant
within 14 days of checkout.
Pets: Dogs or
cats may be allowed in some cases, but must be confirmed in writing
by Lessor prior to stay. An additional $500 pet security deposit
will be due with final payment. Tenant acknowledges that Lessor does
not assume any liability for any injuries, damage, accidents, or any
other claim whatsoever that may arise from said pets. Tenant further
agrees to defend and indemnify Lessor from any and all claims that
may arise from said pets.
Cancellations
and Refunds: All payments are non-refundable unless Lessor is able
to re-rent the property for the same rent for the same period of
time. Reservations that are re-rented are subject to a $150
processing fee. Reservations may be rescheduled, for the same
property and the same number of nights, up to 60 days prior to the
scheduled arrival date, subject to a $150 processing fee.
Returned
Checks: If, for any reason, a check by Tenant is returned, a $50
fee will be incurred.
Terms of
Occupancy:
Violation of
occupancy limits will result in the forfeiture of all monies and
termination of occupancy. Tenant shall keep and maintain the
premises in a clean and sanitary condition at all times, and upon
the termination of the tenancy shall surrender the premises to
Lessor in as good condition as when received. Lessor reserves the
right to inspect the property during your stay.
Upon checkout:
Tenant agrees to close and lock all windows, doors and sliders. All
trash is to be placed in trash bags and placed in trash containers
alongside the garage. All air conditioner units are to be turned
off. If any furniture was rearranged, either inside or outside the
house, Tenant agrees to return it to its original location. Failure
to complete any of the above mentioned will result in partial loss
of security deposit.
Keys: Tenant
will be provided 2 sets of keys to the premises. Both sets will be
on the kitchen counter upon arrival. Both sets of keys must be
returned to the kitchen counter upon departure. If both sets are not
returned upon departure, Tenant shall be charged $150 to change the
locks.
Telephone and
Wireless DSL: Wireless DSL service will be left on and furnished for
Tenant’s convenience. Telephone may also be less on for emergency
purposes only. Local calls are free. Calls to the US and Canada are
charged at $2.00 per minute. Any other international calls are
prohibited and will be charged at 300% of cost. Any charges will be
deducted from the security deposit.
No Smoking
Clause: There shall be absolutely NO SMOKING inside the property.
Evidence of any smoking will result in the full and complete
surrender of your security deposit.
Right of Entry
and Discretion: Lessor reserves the right to enter the premises at
any reasonable hour for the purpose of inspection, and whenever
necessary to make repairs and alterations to the premises.
Lessor has the right to evict Tenant on immediate notice if it is
found that Tenant is abusing the property, disturbing the peace,
exhibiting anti-social behavior or the rental relationship becomes
unworkable.
Liability: The
property is a private residence and Tenant agrees to indemnify
Lessor for any damage, loss or accident that may occur during
Tenant’s stay. Tenant agrees to defend and indemnify Lessor from any
and all claims for damages arising out of Tenant’s use of the
premises or any items associated with the premises. Lessor is not
responsible for, nor does Lessor assume any liability for any
damages caused by any accident, fire, theft, casualty, act of nature
or any other cause whatsoever.
Venue: Tenant
acknowledges and agrees that the venue for any dispute or claim that
may arise shall be made in the city of La Paz, in the state of Baja
California Sur, Mexico.
Tenant
understands and agrees to abide by the above stated terms and
conditions. Tenant understands and agrees that the above stated
cancellation policy is in effect. Tenant understands and agrees that
any damage done to the property, its contents or associated
equipment during Tenant’s stay is Tenant’s responsibility and any
costs for repair or replacement will be Tenant’s responsibility.
